A conveyancer is someone who helps with the legal side of buying or selling property. They act as your guide through the legal steps, handling everything from contracts to title transfers. While they focus specifically on property law, they can manage the conveyancing process just like a lawyer, ensuring everything is done correctly and efficiently.
You should sign a contract once you've reviewed all the details and are comfortable with the terms. For buyers, it’s important to have your finance approved and ensure any conditions (like inspections or financing) are met. For sellers, ensure all the necessary documents are prepared and you’re ready to proceed. Once both parties are satisfied, signing the contract makes the agreement legally binding, and the property transaction moves forward.
In New South Wales, the cooling-off period is a 5-business-day period that starts after the buyer signs the contract for a property purchase during which a buyer can change their mind and cancel the purchase. If the buyer cancels, they lose 0.25% of the purchase price as a penalty. The cooling-off period doesn't apply in all cases. For example, it doesn't apply if the buyer has waived their right to it, or in certain types of property transactions (like auctions).
No, you should not. It is against our professional advice that you attend an auction without understanding the legal aspects of the contract terms before bidding as conveyancers we ensure that you're aware of any potential issues with the property and that you make a confident, informed decision before attending.
The typical conveyancing process takes between 4 to 6 weeks, but this can vary depending on factors like the complexity of the transaction, if you or the seller require a longer settlement date and how quickly both parties provide required documents.
